RIGHTS AND OBLIGATIONS OF THE PARTIES


1. Rights and obligations of the e-commerce platform owner

a) Issue, publish and organise the implementation of operating conditions and transaction conditions;

b) Develop and publish service standards and the process for participating in activities on the platform;

c) Collect service fees in accordance with the published pricing policy;

d) Provide buyers with full or summary information on the applicable promotional formats before they place an order;

đ) Ensure the safe and stable operation of the platform;

e) Specify the cases in which a seller's or buyer's account may be suspended, terminated or restricted;

g) Apply the measures necessary to protect information relating to users' business secrets and consumers' personal information;

h) Receive and resolve requests, reports and complaints from users;

i) Monitor and prevent unlawful conduct; cooperate with and provide information and data at the request of competent state authorities.

2. Rights and obligations of the seller

a) Register, maintain, suspend and terminate the sale of goods and the supply of services; decide on the goods, services, selling prices and promotional policies in accordance with the law and the agreement with the platform owner;

b) Use the platform's technical infrastructure and support tools; access data directly related to its business operations; be assured of full and on-time payment, and have requests, reports and complaints resolved on a public and transparent basis;

c) Provide accurate and complete information; ensure the quality of goods and services; fully perform the obligations of delivery, warranty, exchange, return and refund; not use the platform to trade in sectors and trades in which business investment is prohibited, counterfeit goods, goods infringing intellectual property rights, or to carry out other unlawful acts;

d) Fulfil financial obligations towards the State; protect buyers' data; protect consumers' information; cooperate with the platform owner and competent state authorities in handling legal violations.

3. Rights and obligations of the buyer

a) Have consumer rights protected; be provided with full and accurate information about the goods, services and the seller;

b) Choose goods, services, payment methods and delivery methods; have personal data protected; have reports, requests and complaints resolved in accordance with regulations;

c) Provide the necessary and accurate information; pay in full and on time;

d) Comply with the law and with the platform's operating conditions and transaction conditions; not use the platform to carry out unlawful acts.
